CreatorBrain™ is owned and operated by NM Media LLC ("the Company"). The following terms and conditions govern your use of the CreatorBrain platform and all related products and services. By accessing CreatorBrain, you acknowledge and accept these terms of use. These terms of use are subject to change at any time at the discretion of the Company without notice. Your continued use of CreatorBrain after any changes are implemented constitutes your acceptance of the changes. We encourage you to consult the terms and conditions frequently.

You acknowledge and agree that all content and materials available on CreatorBrain are protected by copyrights, trademarks, service marks, patents, trade secrets, or other proprietary rights and laws. Except as expressly authorized by the Company, you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit, or create derivative works from such materials or content. Reproduction, copying, or redistribution for commercial purposes of any materials or design elements on this platform is strictly prohibited without the express written permission of the Company. Any content generated as part of interactions on CreatorBrain will remain property of the Company. By using the platform and engaging in any interactions, you acknowledge this fact and release ownership. The Company reserves the right to remove, edit, move or close any content item for any reason, including content that violates laws and regulations formed pursuant to the FTC, Federal Food, Drug and Cosmetic Act.

If you upload any material to CreatorBrain (including knowledge base content, training data, or other materials), you warrant that you own the copyright and all other necessary rights in it and you accept all risk and responsibility for it. You grant to the Company the right to process, store, and use it for the purpose of operating the platform. You agree that any material you upload to CreatorBrain grants the Company a non-exclusive, irrevocable, royalty-free right to use that material for platform operation and improvement. You agree to perform all further acts necessary to perfect any of the above rights granted by you to the Company, including the execution of deeds and documents, at the Company's request.

CreatorBrain is an AI-powered platform. All responses from AI clones are generated by artificial intelligence and may not perfectly represent the views of the creator whose content was used for training. AI-generated content does not constitute professional advice (legal, medical, financial, or otherwise). The Company and its creators are not liable for decisions made based on AI-generated content. Creators are responsible for the accuracy and appropriateness of the knowledge base content they provide. The Company does not verify or endorse creator-provided training content.

CreatorBrain may link you to other sites on the Internet or display content from third-party sources. These sites and content may contain information or material that some people may find inappropriate or offensive. These other sites and content are not under the control of the Company. The Company is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such sites. If you decide to access any other websites linked to or from CreatorBrain, you do so entirely at your own risk. Products and services purchased through third-party websites are subject to the terms and conditions of such other parties.

All materials, information, software, products, and services included in or available through CreatorBrain (the "Content") are provided "as is" and "as available" for your use. The Content is provided without warranties of any kind, either expressed or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant that the Content is accurate, reliable or correct, that the platform will be available at any particular time or location, that any defects or errors will be corrected, or that the Content is free of viruses or other harmful components. Your use of CreatorBrain is solely at your risk. Because some jurisdictions do not permit the exclusion of certain warranties, these exclusions may not apply to you.

Under no circumstances shall the Company or its agents be liable for any direct, indirect, punitive, incidental, special, or consequential damages that result from the use of, or inability to use, CreatorBrain. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if the Company has been advised of the possibility of such damage. Because some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, the Company's liability in such jurisdictions shall be limited to the extent permitted by law.

Upon a request by the Company, you agree to defend, indemnify, and hold the Company harmless, and its agents, employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees, that arise from your misuse of CreatorBrain.

Unless otherwise specified herein, this agreement constitutes the entire agreement between you and the Company with respect to CreatorBrain and supersedes all prior or contemporaneous communications between you and the Company with respect to the platform. If any part of these terms of use is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect.

These terms of use shall be governed by and construed in accordance with the laws of the United States and in the English language only. You hereby consent to binding arbitration in the city of Sheridan, Wyoming, United States and in English language, to resolve any disputes arising under these terms of use.

Your purchase of a CreatorBrain subscription or service may or may not provide for any refund. Each specific product, service, or plan will have its own refund policy.

The Company reserves the right to modify or discontinue, temporarily or permanently, CreatorBrain as a whole and/or any or all of its features, products, prices, services or information with or without notice to you. You agree that the Company shall not be liable to you or any third-party for any modification or discontinuance of such features, products, prices, services, or information.

You must not misuse CreatorBrain by knowingly introducing any material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the platform, the server on which the platform is hosted or any server, computer or database connected to it. You must not attack the platform via a denial-of-service attack or a distributed denial-of-service attack. By failing to comply with this provision, you would commit a criminal offense and your right to use the platform will cease immediately. The Company will report your actions to the relevant authorities.
